INTRODUCTION
This document is an electronic record in terms of the Information Technology Act, 2000 and the rules made thereunder. This electronic record is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediary Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the marketplace e-commerce website of My Sala (hereinafter collectively referred to as the “Platform”).
This electronic record is generated by a computer system and does not require any physical or digital signatures. The Platform is owned, operated, and managed by My Sala Private Limited, a company duly incorporated under the provisions of the Companies Act, 2013, and having its registered office at [Registered Office Address] (hereinafter referred to as the “Company”, “We”, “Us”, or “My Sala”).
By accessing, browsing, visiting, or using the Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Use (“Terms”). These Terms govern your access to and use of the Platform and its services. Unless otherwise specified, these Terms do not apply to third-party products or services, which shall be governed by their respective terms and conditions.
TERMS
2.1
By accessing or using the Platform, you are deemed to have accepted these Terms of Use. We reserve the right, at our sole discretion, to modify or update these Terms at any time without prior notice. These Terms constitute a legally binding agreement between you (“User”, “You”, or “Your”) and My Sala.
2.2
A “User” includes any natural or legal person who accesses, browses, registers, transacts, or avails services on the Platform. By accepting these Terms, you also agree to be bound by our Privacy Policy and other applicable policies, guidelines, or rules as may be updated from time to time.
2.3
If you do not agree with any part of these Terms, you must immediately discontinue use of the Platform.
2.4
We do not permit individuals below the age of 18 years to use the Platform without the consent or supervision of a parent or legal guardian.
2.5
Any voluntary contributions, donations, or service charges made at the time of placing an order, if applicable, shall be non-refundable unless expressly stated otherwise under applicable law.
USER REPRESENTATIONS
3.1
The User represents and warrants that they are at least 18 years of age and are competent to enter into a legally binding contract under applicable laws.
3.2
The User agrees to provide accurate, complete, and up-to-date information during registration and use of the Platform. If any information provided is found to be false, misleading, or inaccurate, My Sala reserves the right to suspend or terminate the User’s access.
3.3
The User shall be solely responsible for maintaining the confidentiality of their account credentials and for all activities conducted through their account. My Sala shall not be liable for any loss or damage arising from unauthorized use of the User’s account.
3.4
The User agrees to use the Platform only for lawful purposes and shall not attempt to damage, hack, reverse engineer, decompile, or interfere with the Platform’s functionality.
PERSONAL DATA
4.1
My Sala processes personal data and sensitive personal data in accordance with its Privacy Policy. Users are advised to review the Privacy Policy carefully. By continuing to use the Platform, you consent to the collection, storage, processing, and sharing of your personal information for the purposes described therein.
If you wish to deactivate or close your account, you may contact us at support@mysala.in, and we will process your request in accordance with applicable laws.
REPRESENTATIONS AND WARRANTIES
5.1
The Platform is provided on an “as-is” and “as-available” basis. Your use of the Platform is at your own risk. My Sala disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
We shall not be liable for:
- Any personal injury, health issues, or property damage resulting from use of the Platform or products purchased;
- Unauthorized access to or use of secure servers and stored data;
- Interruption or cessation of services;
- Errors, inaccuracies, or omissions in content;
- Losses arising from reliance on Platform content or third-party seller products.
My Sala has established a grievance redressal mechanism and has appointed a Grievance Officer who shall acknowledge complaints within 48 hours and resolve them within one month from receipt.
5.2
As a marketplace e-commerce entity, My Sala does not impose cancellation charges on Users unless similar charges are also borne by the Company or sellers for unilateral cancellation.
5.3
My Sala records customer consent for purchases only through explicit and affirmative actions such as placing an order.
5.4
Refunds for accepted claims shall be processed within a reasonable time frame as prescribed by the Reserve Bank of India or applicable laws.
5.5
As an e-commerce marketplace, My Sala does not:
- Manipulate prices to gain unreasonable profit; or
- Discriminate between Users of the same class or create arbitrary classifications.
